Will Proposition 65 become bi-costal?! Governor Cuomo has proposed a law that sounds a lot like the famous CA nemesis. Luckily it is just proposed and is missing some bad California ideas.
In his New Year's Address, the Governor pushed for the following:
"The Consumer Right to Know Act":
[A]gencies will assess the feasibility of on-package labeling and develop regulations establishing a labeling requirement for designated products, developing a list of more than 1,000 carcinogens and other chemicals that will trigger labeling and identifying the types of consumer products that will be subject to the new regime.
Sound familiar?
So far this is not claiming to add new chemicals so for those of us already living with Prop 65 you'll just have to label stuff coming to NY too. How do you label cream cheese and lox on a bagel?
The good news is that viper bounty hunter plaintiffs are not part of the regulatory stream like they are in California. But who knows? We will keep watching. There are a lot of plaintiff lawyers in the NY Legislature.
